§ 92.48. COMMISSION OR COURT NOT TO TAKE JURSIDICTION OVER CLAIM FOR UNLAWFUL ACT WHILE SAME CLAIM PENDING BEFORE OTHER BODY; FINAL DETERMINATION EXCLUSIVE.

- As provided by KRS 344.270, the Commission shall not take jurisdiction over any claim of an unlawful act under this chapter while a claim of the same person seeking relief for the same unlawful act under KRS 344.450 is pending. As provided by KRS 344.370, a state court shall not take jurisdiction over any claim of an unlawful act under this chapter while a claim of same person seeking relief for the same unlawful act is pending before the Commission. As provided by KRS 341.270 a final determination by a state court or the Commission of a claim alleging an unlawful act under this subchapter shall exclude any other action or proceeding brought by the same person based on the same unlawful act.(1999 Lou.
