(A) It shall be unlawful for any person to establish, operate or to carry on the business of distributing to any persons in Louisville Metro, any Communications Service by means of a system in the rights-of-way unless a franchise therefore has first been obtained from Louisville Metro, and unless such franchise is in full force and effect.
(B) It shall be unlawful for any person to own, erect, install, maintain, operate, repair, replace, remove or restore within any public street in Louisville Metro, equipment or facilities for distributing any Communications Service through a system, unless a franchise authorizing such use of such rights-of-way has first been obtained from Louisville Metro, and unless such franchise is in full force and effect.
