§ 94.60. DEFINITIONS.

  • For purposes of this subchapter, the following definitions shall apply, unless the context clearly indicates or requires a different meaning:
    AUTHORITY HAVING JURISDICTION ("AHJ"). The Fire Chief (or designee) of the urban services district or a suburban Fire District, as defined by local ordinance or state law, within the jurisdiction where an order is issued.
    FIRE PREVENTION APPEALS BOARD ("BOARD"). An administrative body created pursuant to the provisions of National Fire Protection Association (NFPA) - 1, and appointed for the purpose of hearing and adjudicating differences of opinion between the authority having jurisdiction and the citizens of Louisville Metro in the interpretation, application, and enforcement of the Fire Prevention chapter codified in the Louisville Metro Code of Ordinances, and any state statutes or regulations for which the authority for enforcement has been delegated by the State Fire Marshal.
    FIRE PREVENTION BOARD MEMBER ("BOARD MEMBER"). A member of the Louisville Metro Fire Prevention Appeals Board created herein.
    OFFICER. A fire chief, deputy fire marshal, or designee, with authorization to issue orders in accordance with provisions of the Fire Prevention ordinances.
    ORDER. The official, written determination that a violation of a state or local law or regulation dealing with fire prevention has occurred. This term shall also include "Citations" or "Notices of Violation" issued in connection with an alleged violation under the provisions of this chapter.
