§ 94.61. BOARD REQUIREMENTS.

  • (A) Creation and membership. There is hereby created, pursuant to Section 1-8 of the National Fire Protection Association (NFPA) - 1 Pamphlet, a Fire Prevention Appeals Board for the Louisville/Jefferson County Metro Government.
    (B) Appointment and removal.
    (1) Members of the Board shall be appointed by the Mayor of Louisville/Jefferson County Metro Government.
    (2) A Board member may be removed from office by the Mayor for misconduct, inefficiency, or willful neglect of duty. The Mayor must submit a written statement to the member setting forth the reasons for removal.
    (3) Any Board vacancy shall be filled by the Mayor within 60 days of the vacancy. If the vacancy is not filled within that time period, the vacancy shall be filled by majority vote of the remaining Appeals Board members at their next meeting.
    (4) A Secretary for the Board shall be appointed by the Secretary of the Cabinet for Public Protection from time to time, as needed. This person shall be responsible for scheduling hearings, sending notice, and keeping minutes for Board meetings. This person may be a member of the Board, a member of the Louisville Metro administration, or of the general public.
    (C) Members.
    (1) Board members shall not be officers, agents, or employees of Louisville/Jefferson County Metro Government.
    (2) Members shall be appointed by reason of education, knowledge and experience, and be deemed competent to sit in judgment on matters concerning the NFPA - 1 Fire Prevention Code and its enforcement.
    (3) No more than one Board member shall be engaged in any particular business, profession, or line of endeavor.
    (D) Terms.
    (1) The members of the Board shall consist of seven individuals, who shall serve three-year terms, except the initial appointees, who shall serve as follows:
    (a) Two members for a term of one year;
    (b) Two members for a term of two years;
    (c) Three members for a term of three years.
    (2) Upon expiration of the initial term, members may be reappointed to the Board for subsequent three-year terms.
